Jenny Firkin chairs a seminar hosted by the Victorian Bar’s Equality and Diversity Committee. Kate Eastman S.C. of the NSW Bar Association, Chair of the ABA Diversity and Inclusion Committee, examines both conscious and unconscious bias and the role it plays in the workplace, and in work at the Bar. Kate discusses the (in)ability of both the laws enacted, and the policies and practices adopted by organisations and governments surrounding equality and diversity to fix the problem unconscious bias poses. Ms Eastman covers differences between proving actual/explicit bias and apprehended bias, and the ways in which lawyers contemplate the familiar concept of bias in the courtroom.
